Right of Withdrawal

If the service has been rendered for the project — even partially — a withdrawal is no longer possible and the service must be paid according to the project progress. If the service has already been fully rendered, in any case the full contract value agreed at booking / commissioning must be paid.

Right of Withdrawal

The right of withdrawal does not apply, unless otherwise specified, for distance contracts for the delivery of goods which are made to customer specifications, clearly tailored to personal needs, or which by their nature are not suitable for return.

If no processing has yet begun, the usual withdrawal terms apply as follows:

• You have the right to withdraw from this contract within fourteen (14) days without giving any reason.
• The withdrawal period is fourteen days from the day
• in the case of a purchase contract: on which you or a third party named by you — who is not the carrier — have taken possession of the last goods;
• in case of a contract for multiple goods ordered in a single order but delivered separately: from the day on which you or a named third party took possession of the last goods;
• in case of a contract for delivery of goods in several partial shipments or pieces: from the day on which you or a named third party took possession of the last part or piece;
• in case of a contract for regular delivery of goods over a defined period: from the day you or a named third party took possession of the first delivered goods.
• If several of the above alternatives apply, the last date is authoritative.

To exercise your right of withdrawal, you must inform us (Blynk GmbH, Bernhard-Nocht-Strasse 89–91, 20359 Hamburg) by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that you send the notification of your exercise of the right of withdrawal before the withdrawal period expires.

Effects of Withdrawal

In the event of a valid withdrawal, all services received by both parties must be returned and any benefits derived must be surrendered. If you cannot return the received service in full or only in a deteriorated condition, you may have to provide compensation for the lost value.

Any payments you made must be refunded within 30 days. The period starts for us upon receipt of your withdrawal declaration or the returned article — for you upon dispatch.

In the case of a service contract, the right of withdrawal expires prematurely if the service provider has begun with the performance of the service with your explicit consent before the end of the withdrawal period, or if you have yourself requested that the performance begin.
